John2 was not 21 at the writing of his fathers will dated O ct 2, 1679and proved in N.Y. City February 2, 1680; howeve r about 1680 Anthony Summers brought suit before Court of M ayor and Aldermen of N.Y. City against Frederick Phillipse , Administrator of John1 Legate, deceased, for £51 15sh. fo r "dyett and lodging and maintaining of John2 ye son ofJohn 2 Legate, deceased, for 5-1/4 years at £8 per annum, Bosto n money, as by account."

From the Collegiate Dutch Church record, New York. "Septemb er 14, 1688, Jan Leggett, y.m. van de Barbadoes en Catalin e Ten Broeck, y.d. Albian d'uste wonunde alheir, entevede t ot N. Albanien. (in the Margin) vertoog um to troueven to t N. Albanien."

Translation:

"John2 Leggett, young man of the Barbadoes and Cataline Te n Broeck, young maiden of New Albany, the first living her e and the second at Albany."

The record of the First Reformed Church of Albany gives th e same marriage, but the date is October 7, 1688.

The Tax Lists of New York City for the years 1695 to 1699 ( N.Y. Historical Society record ) show that Catelina, wido w of John2 Leggett, wasassessed for a house in the south wa rd. John2 Leggett, her husband, had died in 1693 or 1694, a ged about 30 years.

His widow married after 1699 John Lissjer.

Note:

John Leggett in 1657 inherited the residue of his father' s estate andwas appointed executor of his will. He was stil l living in Ely in 1665 when he was made executor of the es tate of his brother William. Johndisappears from the record s after this and may well have emigrated toAmerica with hi s brother Gabriel.

John Leggett was called a shipbuilder, and on November 30 , 1676, he executed a bill of sale reading:
"John Leggett of Westchester, within the Province of N.Y. , shipright,to Jacob Leysler of New York City, merchant , a good Puick, or ship, Susannah of New York, now lying i n this harbour, and by said Leggett built in Bronck's rive r near Westchester, together with masts, Lay boat,and othe r materials."

Thus the shipbuilding industry was introduced at the mout h of the Bronx as early as 1676 (probably earlier) - that i s, seven years or more before the organization of the Count y of Westchester. This John Leggett, builder of the Susanna h, died in the West Indies in 1679. It is interesting to no te that he named as his executor the first Frederick Philip se, with whom he seems to have sustained a business partner ship of some kind, and to whom he bequeathed the sum of thi rty pounds sterling.

Of John Leggett, the Mariner, Theodore Leggett states:

We may believe him to have been the elder brother of Gabrie l [most likely true]. His home was in Westchester, Provinc e of NewYork. He died in the West Indies. His son is afterw ards registered "of Barbadoes;" one of the circumstances co nnecting the family with the first John Leggett of Barbadoe s. The following transcript of his will furnishes aboutal l the knowledge we at present have of him.

"Will of John Leggett of Westchester, made at Port Royall , in the Island of Jamaica, dated Oct. 2nd, 1679. Letters t estamentary granted to Ffredrich Phillips, as Executor by S ir Edmund Andros, Feb 2nd, 1680, reciting: Whereas John Leg gett, late of Westchester, marriner, departedthis life on t he Island of Jamaica, and that his last will hath been prov ed in the court of the Mayor and Alderman of New York City , and security given by the Executor."

"In the name of God, Amen: I, John Leggett, now of Port Roy all, in the island of Jamaica aforesd marriner, being ver y weake and sick in body but of sound mind and memory (Prai se be therefore given unto Almighty God for the same), do m ake this my present last will and Testament, in the manne r and form following (that is to say) my body I commit to t he Earth to be decently Buryed, and as touching all such wo rldly estate God of his mercy hath been pleased to blesse m e with all. I give, will and dispose of as ffolloweth, firs t, I will that all my debts and funerall charges shall be p aid and discharged. Item, I give and bequeath unto my wel l beloved son John Leggett all that my one half part of th e Ketch Tryall of New York, one negro boy now on board th e sd Ketch,known by the name of 'You-Boy.' one Hogshead o f sugar, one Barrell and eleaven gallons of Rum, Two barrel ls of Lyme Juice on board the sd Ketch, and all my wearin g apparel both linen and woolen, a piece and remnant of whi te linnen: and all the rest and residue of my personal esta te whatsoever (not being before bequeathed) I give and bequ eath unto my now wife Anne Leggett, and unto the child sh e now goes withall, if it shall live to the age of two year s.
I give and bequeath the sum of Thirty pounds Sterling to b e paid out of the porcon or estate before hereby given unt o my said son John to my good friend Mr. Frederick Phillip s now of New York in America, merchant, whom I do hereby ma ke full and sole executor of this my last willand Testament , in trust to and for the only uses and intents above menci oned, and desire him to take care of my sd son John Leggett , and bring him up, or cause him to be bred up to the sea f or his livelyhood, and to pay all the above sd porcon of m y sd son John at the age of oneand twenty years together wi th all such profits and produce as shall or may be made the reoff and improved. And as touching the legacy hereby give n to my sd wife I will that she shall have and receive th e same immediately after my interment and Buryall and I d o hereby revoke, disannull and make void all former wills a nd Testaments whatsoever heretofore by me either made or sp oken and will this and no other to be my last will and Test ament. In witness, I, the said John Leggett have hereunto s ett my hand and seal the 2d day of October Anno Domini, 167 9.

Theodore Leggett goes on to reinforce the links of the West chester Leggetts with Barbados:

"Frederick Philipse, the executor of John Leggett's will, w as at thistime the wealthiest citizen on the continent, an d one of the most distinguished citizens of the Province o f New York. When, after the Dutchhad regained New York an d money was needed for its defence, it was resolved to rais e it by a forced loan from the most affluent inhabitants, F rederick Philips heads the list of 62 names assessed for 80 , 000 guilders. He was a member of the Council under the En glish Governors from Andros to Bellamont. In 1680 he acquir ed the Manor, and was first lord of Phillipsburgh, Westches ter County. He died 1702, aged seventy-six years.
As another link in the evidence connecting the Westcheste r Leggetts with John Leggett of Barbadoes, Frederick Philip se, friend of John Leggett, the mariner, was a large land o wner in Barbadoes, the "SpringheadEstate;" there his son Ph ilip was born in 1676, resided, and married the daughter o f Gov. Sparks of Barbadoes, and his son, the Hon. Frederic k Phillips, was born in that Island, 1698, and became the s econd lord of the Manor of Philipsburgh."

Theodore Leggett also lays out a pedigree for the descendan ts of JohnLeggett, the Mariner:

John, Gabriel's Elder Brother, Known as John Leggett the Ma riner

The English records prove that Gabriel did indeed have an e lder brother named John, as Theodore Leggett speculated, an d I believe he is correct in his supposition that this wa s the man known to us as John Leggett the Mariner. Actually , Gabriel was the youngest of the seven children of Gabrie l Leggett and his wife Susan Kilbourne, and had five brothe rs, Thomas (1626-1636), John (1628-1679/80?), Richard (1630 -1630), William (1632-1665), Edward (1633-1636) and a siste r Katherine (1635-1638)). Most of these siblings died in in fancy; only Gabriel and John (apparently) lived to a decen t age. John was in England as late as July,1665, when he se rved as executor for his brother William's estate, who die d at the age of 33. John disappears from the English record s after this, and most likely did go to America. His fathe r had died in 1657, brother Gabriel left in 1661, but his m other lived until 1670. If the religious and political situ ation permitted it, perhaps he did not emigrate until afte r her death, when he would have been the only one living o f his immediate family left in England. We really have no p roof that this John, born in Ely in 1628, is the same man f rom Westchester,New York who died in Jamaica in 1679; no mo re so, really than that the Gabriel Leggett born in Ely i n 1637 is the one who was buried on Hunt's Point, New Yor k in 1700. Of course, it is true that "John" is a very comm on name, while "Gabriel" is very rare, so we may be much mo re certain of the latter than the former. I think it most p robable, however (more likely than not) that John Leggett , the elder brother of Gabriel, born in England in 1628, an d John Leggett the Mariner are one and the same man.
