James prepared a Lincoln Co., KY will on 1 May 1801. It was probated 15 July 1801 (Book C, page 130)

James Givens of Lincoln Co. gives oldest son, Samuel,the track of land James lived on currently, being 152 acres which was purchased from Robert Daugherty. To Robert Givens, 200 acres where he formerly lived. To son, James Givens, 440 acres of land claimed in Tennessee on the waters of the Red River being a part of the preemption of 640 acres granted to James Sr. by the Governor of North Carolina as one of the original settlers of Cumberland County. To son John Givens, 50 acres of land to include the plantation whereon he now lives. Should he leave this land it is to revert to another son Benjamin upon payment of 150 pounds to the said John Givens. Benjamin was to receive the plantation where his father lived with all the residue of land the senior John lived on but hadn't alread bequeathed and the residue of the land purchased from the executors of John Carpenter, deceased. To his wife Martha he gave his negro women, Cate and Mary. To his son Benjamin his slaves Dick, Jack, Mary Willoby, Cabbell and Hannah. Benjamin was to pay to his sisters, Sally Campbell and Martha Givens in property $50 at the end of 12 months after James' decease. Daniel was to also to provide his mother with an adequate living. Daniel also was to receive all the livestock and farm implements owned by his father. Robert and Benjamin Givens, sons, were named executors. Signed by James Givens. Witnesses: George Givens and Isaac Shelby.
There is a codisill stating that Benjamin is to pay John his brother $50 to make his share even with his brothers.
The Will was proved in court 14 Jul 1801.

15 Nov 1752 - Samuel Givens and Robert Patrick to view (?), & John Givens and others to keep in repair a road from James Givin's mill to the road over Wood's new Gap at foot of mountain.
15 Mar 1757 - James Givens and Martha sold to Geo. Crawford 311 acres on Middle River patented to Givens 30 Aug 1743.
14 Mar 1757 - James bought from William and Jean Givens trust on Middle River patented to Sarah and William Givens on 30 Aug 1743.
1758 - James Givens was in Augusta Co. militia during the French and Indian war (was this this James Givens?)
8 Jul 1760 - Money due James Given from Robert Ramsey.
1763 - James Givens vs John Stewart of Staunton and Thomas Fulton over the sale of a slave.
1763 - James Givens and Martha sold to Samuel Henderson 7 3/4 acres on Middle River part of 311 acres on which said Givens lives and at the same time bought from Samuel Henderson 4 1/2 acres adjoining land said Givens lives on.
18 Aug 1767 - Hugh Allen surveyor of highways from James Given's Mill by his house to Stone Meeting House. Tithables from James Craig's up Middle River to James Givens.
17 Mar 1768 - John Bodkin apptd surveyor of highway, vice John Estill, from James Given's to head of Cow Pasture River.
1775 - Capt. James Givens and his son, Capt. Robert Givens with Thomas Sharpe Spencer and other planted corn in Cumberland Valley - were first white men to do so.
1776 - James Givens, Middle River - In Augusta Co. Fee books.
11 Jun 1782 - (Lincoln Co. Index Book) -Surveyed for James Givings assignee of Henry French 400 acres of land in part of treasury warrant on Hanging Fork.
1783 - Tithables - James Givens & sons Robert, Samuel and James.

1790 - John Logan to James Givens - 150 acres - Hanging Fork.
LOCATION: James Givens' Mill was probably located on the house tract of 311 a. inherited from his father. James in 1757 sold his original 311 a. to George Crawford, but at the same time bought from his brother William the house tract of 311 a. So from 1757 on James was living on the house tract of land. But he already had a mill in 1752. From the fact that the father, Samuel Givens got his 1000 a. on 23 Oct 1739 and made his will the day before, leaving the dwelling house, etc. it seems likely that it as on the land which he thought was Beverly's and therefore perhaps NEAR Beverley Monor, but outside it

BIOGRAPHICAL: From History of the Pioneer Families of Missouri by Bryan and Rose, St. Louis, 1876, "St. Charles County." - James Givens, of Augusta Co., VA, had the following named children - Robert, Samuel, James Jr., John, Benjamin, and Martha. They all settled in Lincoln Co., KY in 1780.
LAND: There is an 1809 Deed (F-171) - Harrison and Daugherty to Samuel Givens for 140 acres on H (Henderson?) Creek. This does not identify this 140 acres with the 142 acres which Janes says in his will that he got from Daugherty. There is no deed for the transaction between James and Daugherty. Possibly the transaction was never completed before James died and wasn't finished until this deed in 1809.
